What Is OSHA?

OSHA was created under the Occupational Safety and Health Act of 1970 (OSH Act), which Congress enacted in response to the growing number of workplace injuries, illnesses, and fatalities occurring across American industries.

Before OSHA's creation, workplace safety regulations were inconsistent and often nonexistent. Employers were largely responsible for establishing their own safety procedures, resulting in significant variations in worker protection. The OSH Act established nationwide minimum safety requirements and gave OSHA the authority to develop, enforce, and interpret occupational safety regulations.

Today, OSHA regulates millions of workplaces and protects well over 100 million workers through inspections, enforcement actions, education, outreach, and safety standards. Electrical safety remains one of OSHA's highest priorities because electrical incidents frequently result in severe injuries or fatalities, including:

The Occupational Safety and Health Act of 1970

The legal authority for OSHA comes from the Occupational Safety and Health Act of 1970, commonly called the OSH Act.

The General Duty Clause

One of the most misunderstood portions of the OSH Act is Section 5(a)(1), commonly known as the General Duty Clause.

It states that every employer must furnish employees with:

"...employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm."

This clause becomes extremely important whenever OSHA has not written a regulation covering a specific hazard.

For OSHA to issue a General Duty Clause citation, four elements generally must be present:

  1. Employees were exposed to a hazard.
  2. The hazard was recognized.
  3. The hazard could cause death or serious physical harm.
  4. A feasible method existed to eliminate or reduce the hazard.

Why the General Duty Clause Matters in Electrical Safety

Electrical technology evolves rapidly.

New hazards involving:

  • Battery Energy Storage Systems (BESS)
  • Utility-scale solar farms
  • Electric vehicles
  • DC fast charging
  • Data centers
  • Renewable energy
  • Industrial automation

often emerge faster than OSHA can publish new regulations.

In these situations, OSHA may rely on the General Duty Clause when an employer fails to protect workers from a recognized electrical hazard.

Consensus standards—such as NFPA 70E—may be used as evidence of what constitutes recognized safe practice, but the citation itself is based on the General Duty Clause or another applicable OSHA regulation, not on NFPA 70E directly.


OSHA Regulations vs. Industry Standards

This is one of the most important distinctions electrical workers should understand.

OSHA Regulations

OSHA regulations are federal law (or state law in OSHA-approved State Plan states).

They are legally enforceable.

Failure to comply can result in:

  • Citations
  • Monetary penalties
  • Required corrective actions
  • Increased liability
  • Criminal penalties in limited circumstances

Consensus Standards

Organizations such as:

  • NFPA
  • ASTM International
  • IEC
  • ANSI
  • IEEE

publish consensus standards.

These documents are developed by technical committees composed of engineers, manufacturers, employers, labor representatives, regulators, and subject matter experts.

Consensus standards are generally not laws by themselves.

Instead, they become enforceable only when:

  • Adopted into regulation,
  • Incorporated by reference into law, or
  • Used by OSHA to demonstrate recognized industry practice under applicable regulations or the General Duty Clause.

Understanding this distinction helps employers know which requirements are mandatory by law and which represent industry best practices.


Does OSHA Enforce NFPA 70E?

A common misconception is that OSHA "enforces NFPA 70E."

This is not technically correct.

OSHA has stated repeatedly that NFPA 70E is not an OSHA regulation.

However, OSHA recognizes NFPA 70E as the primary consensus standard addressing electrical safety in the workplace and has historically based portions of its electrical safety-related work practice regulations on earlier editions of NFPA 70E. OSHA may also reference NFPA 70E when evaluating whether an employer implemented recognized methods to control electrical hazards.

Practical Example

If an employer allows energized work without performing an appropriate hazard assessment, without establishing safe work practices, or without providing suitable PPE, OSHA may issue a citation under applicable OSHA regulations or the General Duty Clause. During the inspection, OSHA may cite NFPA 70E as evidence of widely accepted industry practice supporting the expectation that those hazards should have been addressed.


OSHA and the National Electrical Code (NEC)

Another area of confusion involves the relationship between OSHA and the National Electrical Code (NFPA 70).

The NEC is primarily an installation code.

It establishes requirements for:

  • Electrical wiring
  • Equipment installation
  • Overcurrent protection
  • Grounding and bonding
  • Wiring methods
  • Equipment locations

OSHA's electrical installation regulations are based on principles found in the NEC, but OSHA's rules are written as federal regulations and are performance-oriented rather than simply adopting every NEC provision. OSHA revised Subpart S in 2007 to better align with more current consensus standards while maintaining its own regulatory framework.


OSHA and ASTM Standards

ASTM International develops consensus standards covering many aspects of worker safety.

Examples include:

  • Insulated hand tools
  • Protective clothing
  • Face shields
  • Rubber insulating equipment
  • Material testing

For companies using 1000V insulated hand tools, ASTM F1505 is particularly significant because it establishes performance and testing requirements for insulated and insulating hand tools.

OSHA does not enforce ASTM F1505 directly. However, employers selecting insulated tools should ensure the equipment is appropriate for the intended use and maintained in a condition that continues to provide the necessary electrical protection. Consensus standards such as ASTM F1505 can help demonstrate that a tool has been designed and tested for electrical work.


OSHA and IEC Standards

Many electrical contractors, manufacturers, and utilities operate internationally.

Because of this, they frequently use tools certified to IEC 60900, the international standard governing insulated hand tools for live working.

IEC 60900 establishes rigorous requirements for:

  • Dielectric testing
  • Mechanical strength
  • Flame resistance
  • Adhesion of insulation
  • Marking
  • Manufacturing quality

Although OSHA does not enforce IEC 60900 directly, employers using internationally certified tools often rely on IEC-compliant equipment as part of an overall electrical safety program. OSHA's focus remains on whether the equipment is suitable, properly maintained, and used safely for the task being performed.


OSHA's Philosophy on Electrical Safety

One of the most important concepts to understand is that OSHA generally regulates workplace safety outcomes, not individual products.

For example, OSHA does not publish regulations specifying:

  • The brand of insulated screwdriver to purchase
  • The manufacturer of voltage testers
  • The model of insulated ratchet
  • The color of PPE

Instead, OSHA requires employers to provide equipment that is:

  • Suitable
  • Properly maintained
  • Appropriate for the hazard
  • Used correctly
  • Inspected when necessary
  • Supported by employee training

This performance-based approach allows employers flexibility while still holding them accountable for protecting workers from recognized electrical hazards.
